Filing a DMCA takedown notice

If you believe content on this site infringes your copyright, you may submit a written notice that includes all of the following:

  1. Your physical or electronic signature (typed name is acceptable for email notices)
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are involved, you can list them.
  3. Identification of the infringing material with enough detail for us to locate it - a direct URL is best
  4. Your contact information - full name, address, phone number, and email
  5. A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  6. A good-faith statement that the use of the material is not authorized by the copyright owner, its agent, or the law

If any of these elements are missing, we may not be able to act on your notice.

What happens after we receive a notice

  • We acknowledge receipt within 2 business days
  • We review the notice for completeness and good-faith basis
  • If the notice is valid, we remove or disable access to the identified material within 5 business days
  • We notify the person who posted the material (if applicable) and give them an opportunity to file a counter-notice

Filing a counter-notice

If your material was removed and you believe it was removed in error or as a result of misidentification, you may file a counter-notice. The counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the URL where it appeared before removal
  3. A statement under penalty of perjury that you believe the material was removed as a result of mistake or misidentification
  4. Your contact information
  5. A statement consenting to jurisdiction in the courts of Saint Vincent and the Grenadines, and that you will accept service of process from the person who filed the original notice

If we receive a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10 business days, we may restore the material.

Repeat infringer policy

In accordance with the DMCA, ScriptHaven Digital Ltd. has a policy of terminating, in appropriate circumstances, the access of users who are repeat infringers. We track all takedown notices and the parties involved.

Misuse of the DMCA process

Filing a false or bad-faith DMCA notice may result in legal liability for damages under Section 512(f) of the DMCA. Don't use this process to harass competitors, suppress criticism, or take down content you don't actually own. We review every notice and report obvious abuse.
